Welcome to Fit and Feline (the “Platform,” “App,” “Website,” “We,” “Us,” or “Our”). These Terms and Conditions (“Terms”) govern your access to and use of our mobile application, website (https://fitandfeline.com/), and all associated fitness accountability, body measurement tracking, mood monitoring, and activity logging services (collectively, the “Services”).
By downloading, installing, registering an account on, or otherwise using the Fit and Feline application or website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, do not use our Services.
1. Acceptance of Terms & Eligibility
- Age Requirement: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use our Services. By using Fit and Feline, you represent and warrant that you meet this requirement.
- Account Registration: To access certain features of the app (such as body measurement tracking, mood monitoring, and progress logs), you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are solely responsible for all activities that occur under your account.
2. Important Health and Medical Disclaimer
- Not Medical Advice: Fit and Feline is a fitness, wellness, and accountability application. We are NOT a medical provider, doctor, physical therapist, or registered dietitian. The content, guidance, workouts, and tracking tools provided through our App are for informational and general wellness purposes only and do not constitute medical advice, diagnosis, or treatment.
- Consult Your Physician: Always consult with a qualified healthcare professional before starting any new fitness program, diet, gut detox, or nutrition plan, especially if you have pre-existing medical conditions, injuries, are pregnant, or take regular medications.
- Assumption of Risk: You acknowledge and agree that participation in physical fitness activities carries inherent risks of injury, ranging from minor sprains to severe injury or death. You voluntarily assume all risks associated with your use of our Services, workout routines, and programs.
3. User Conduct and Acceptable Use
You agree not to use the Fit and Feline platform to:
- Violate any applicable local, state, national, or international law or regulation.
- Upload, transmit, or distribute any harmful, threatening, abusive, defamatory, obscene, or infringing content.
- Attempt to gain unauthorized access to our servers, user accounts, or computer systems connected to Fit and Feline.
- Reverse engineer, decompile, or extract the source code of the Fit and Feline application.
- Use automated scripts, bots, or scrapers to access the Services or harvest user data.
4. User-Generated Content & Data Tracking
- Your Data: You retain full ownership of the data you input into the App, including body measurements (bust, underbust, waist, hips), mood logs, activity logs, and progress photos (“User Data”).
- License to Provide Services: By submitting User Data to Fit and Feline, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display such data solely as necessary to provide, maintain, and improve the app’s accountability and tracking features for you.
5. Intellectual Property Rights
All content, features, software, graphics, designs, logos, text, and trademarks comprising the Fit and Feline website, mobile app, and associated digital publications (such as FIFE Magazine) are the exclusive property of Fit and Feline and are protected by international copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.
6. Termination
We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise detrimental to Fit and Feline. You may terminate your account at any time by deleting the app and following account closure procedures within your settings.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Fit and Feline, its founder, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, arising out of or in connection with:
- Your access to or use of (or inability to access or use) the Services;
- Any conduct or content of any third party on the App; or
- Personal injury or property damage resulting from your participation in fitness activities tracked or suggested by the App. In no event shall our total aggregate liability to you exceed the amount paid by you, if any, to Fit and Feline in the past six (6) months.
8. Indemnification
You agree to defend, indemnify, and hold harmless Fit and Feline, its affiliates, and its leadership from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms, your misuse of the Services, or your violation of any rights of a third party.
9. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and notify users via the App or website. Your continued use of the Services after such changes constitutes your binding acceptance of the updated Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Nigeria.
